Fire Safety in Buildings.
In order to face a demanding market while providing a quality response to our clients, we have improved our services in the Buildings Fire Safety department.
Despite the legislative requirements, that are the result of a compilation of disperse and dissonant legal documents, being mandatory since 2009, its enforcement has not yet became standard. This is happening mostly because of lack of information amongst land lords and estate owners.
This beeing considered, while following legislative restrictions and guidelines in regard to responsabilities related to
Fire Safety in Buildings 3rd and 4th hazard categories projects and plans, we place great importance in our human resources training, having in our team technicians with proper certified qualifications in order to provide a great response in this particular area.

The Civil Protection National Authority has the competence to execute the required verifications through:
- Inpections for usage concession authorization;
- Inpections to verify the implementation of aproved Fire Safety in Buildings conditions and
protective measures execution."

Fire Safety in Buildings applicability:
"
1 - The following are subjected to fire safety regulations:
a) Buildings or their independent units, regardless of usage or surroundings;
b) Backup buildings for fuel stations, such as commercial, food and drinks or workshops establishments, in according to the Legislative Enactment number 267/2002 and 302/2001, datted from 26th November and 23rd November, respectivelly.
c) Housings.
2 - The following are excluded from the previous number:
a) Prison facilities and restricted access facilities to armed or security forces;
b) Ammunitions or explosives depots and firing ranges.

Responsabilities:
"
The responsability for creating a 3rd and 4th hazard category Buildings Fire Safety project, while upholding the current Legislative Enactments, has to be assumed by an architect acknowledged by the Architects Association, by an engineer acknowledged by the Engineers Association or by a technical engineer acknowledged by the Technical Engineers Association with a valid specialization certificate (…)."
The updated listings with certified authors for Buildings Fire Safety 3rd and 4th hazard categories projects and plans are available at the Civil Protection National Authority website.

Transitional Regulation:
"
1 - The projects for buildings and housings, whose licensing have been requested before current Legislative Enactment envigoration are evaluated and ruled in accordance with the enforced legislation correspondent to the submission date.
2 - For appreciative effects of
autoprotection measures, in accordance to the article 15th technical regulation, the information must be electronically submitted by the refered entities in the 6th article in the following deadlines:
a)
30 days previous to functioning, for cases of news constructions, remodelations, enlargements or usage alterations;
b)
One year maximum, after current Legislative Enactment enforcement (January 2010), for buildings and housings previously existent."
The failure to respect Buildings Fire Safety regulations is sanctioned as
considered offense and correspondent fine applied, wich can go from 180€ to 44.000€.

Energetic Certification.
During construction, sale or buildings rental, there must be an energetic performance certification. These certifications must include ideal energetic performance reference values and are valid for 10 years. Certifications must include improvement recomendations and information about their economic viability. Certification must be performed by qualified technicians.
In 2006, the Portuguese Legislation overcame the 2002/91 European Community regulation through the following legal documents:
78/2006 Legislative Enactment
79/2006 Legislative Enactment (Residential buildings; Small services buildings without centralized climate control systems or with P ≤ 25 kW systems; Simplified methodology for certifying existent buildings).
80/2006 Legislative Enactment (Service buildings: Large (>1000 m2 ou 500 m2); Small buildings with climate control (P > 25kW); Residential buildings with climate control systems P > 25kW).

"A building or unit energetic certification is a document related with the National System for Buildings Energetic Certification and Indoors Air Quality, wich provides information regarding its energetic performance in a scale from A+ to G.
This document should contain possible energetic performance and comfort improvement measures, highlighting the most economically viable.
Since July 2008, all new buildings are obliged to have a valid certificate. In the case of existent buildings, since 2009 are required to have a valid certificate for sale or rental purposes. The lack of possession of this document is
sanctioned as considered offense and correspondent fine applied (Legal Enactment 78/2006 4th of April)."
